The Dutch Linking Act

Professor Paul Minderhoud gave his inaugarial lecture at Utrecht University on January 26th on The Dutch Linking Act. The Dutch Linking Act regulates that foreign nationals who do not reside lawfully in the Netherlands are excluded from access to all benefits and provisions. The scope of this exclusion is extended to Dutch nationals  and lawfully residing foreign nationals who have a partner or co-habitant who does not reside lawfully. They are also excluded of important provisions as care allowance, rent allowance, childcare allowance or a child budget benefit. This blog discusses the excessive and unjust consequences of this exclusion, especially when children are involved. Also some solutions to address these problems are presented.
