Research on compensation of damage resulting from mining activities

UCALL-researchers Eddy Bauw and Emanuel van Dongen, together with Martijn van Kogelenberg en Michiel van Rede (both affiliated with the Molengraaff Institute for Private Law), conduct a comparative research on the compensation of damage resulting from mining activities. Ucall-researchers Ivo Giesen and Esther Engelhard act as advisors to this project. The project is financed by the Ministry of Economic Affairs.

The comparative research focuses on the current statutes and regulations, as well as on their enforcement in The Netherlands, Belgium and Germany, regarding the compensation of damage resulting from mining activities. More in particular, the research examines the damage to immovable property of individuals as a result of previous coal mining. This research will assess (among other things) whether the government and corporations award these kind of compensations more generously in Belgium and Germany than in The Netherlands.
