Blog post on Dispute Settlement Under the BBNJ Agreement

On 15 May 2023, Lan Nguyen, Danae Georgoula and Alex Oude Elferink published a post at EJIL Talk!, the Blog of the European Journal of International Law entitled “Dispute Settlement Under the BBNJ Agreement: Accepting Part XV of the UNCLOS with a Twist”. 

On 4 March 2023, the Implementing Agreement on the Conservation and Sustainable Use of Marine Biological Diversity of Areas Beyond National Jurisdiction (BBNJ Agreement) under the United Nations Convention on Law of the Sea (UNCLOS) was adopted after nearly two decades of negotiations. The BBNJ Agreement incorporates the dispute settlement system of Part XV of UNCLOS, while introducing new conditions and limitations for the availability of compulsory procedures. The blog post provides a first assessment of how dispute settlement under the BBNJ Agreement differs from UNCLOS and the implications of these differences.
