Title

The emergence of European Regulatory Agencies. How to reconcile their effectiveness and legitimacy concerns?

Abstract

The new European Supervisory Authorities confirm the otherwise still very embryonic development of EU regulatory agencies. Because of the - soft - regulatory powers that have been assigned to them, concerns of both legitimacy and effectiveness present themselves. By making a detailed case study of one of these EU agencies – the European Securities and Markets Authority (ESMA) - it is possible to analyse what changes in terms of institutional and good governance guarantees would be required with a view to ensuring compliance of regulatory procedures of EU agencies, like those of ESMA, with both the principles of legitimacy and effectiveness.
