Family care: informal caregiving within the family from a legal perspective (PhD Research) 01.10.2017 to 01.08.2023
General project description

Femke is conducting research on the legal aspects of family care. Family care is - in this project - care that adult children provide to their parents and is a type of informal care. The care responsibility that the government carries for elderly people in need of care is changing as a result of the aging population and increasing (financial) pressure on the welfare state. In its policy, laws and regulations, the government is increasingly encouraging family and informal care. The responsibility for caring for the elderly is therefore shifting from the government to the family. This is not without its problems. Due to social changes in the structure of contemporary family, they are not always available or willing to provide care. In addition, family care entails risks such as overburdening, loss of income and conflicts in the family sphere. This raises questions such as, what role does the government has in enabling families to provide care and protecting them from the risks of family care? This study identifies how government policies and laws and regulations deal with this issue. The aim is to create an overview of the legal position, rights and obligations of family caregivers in the Netherlands, both within public and private law, in a clear and systematic manner. This overview does not exist to date and much is still unknown about the legal world of a family caregiver. In addition, it examines whether there are areas for improvement within government policy and legislation and regulation in the field of family care. This question is answered by comparing the goals of the policy, the laws and regulations and information about the practice of family care. In these times of an aging population and great pressure on public spending on care, this question is of fundamental importance.
