Profile

Prof. Dr. Anna Gerbrandy (1971) is professor of Competition Law at the Europa Institute of Utrecht University School of Law, the Netherlands. She is visiting professor at Cha Foscari Univiversity and at the European University Institute in Fiesole. Anna is member of the Research Group Renforce and co-leader of the Sustainability pillar of the University’s Research Focus on Institutions for an Open Society.

After graduating Anna worked as European Law advocate at one of the leading law firms of the Netherlands and as senior law clerk for the competition law chamber of the district court of Rotterdam before returning to Academia.

 In 2009 she defended her cum laude-dissertation on “Convergence in Competition Law”. Anna’s current research focus lies on the interplay between Competition Law and public interests and more generally on the theoretical foundations of both Competition Law and Public Economic law in the changing societal European context. Her institutional responsibilities cover both research and education. Furthermore Anna holds several positions of trust, both within the University and in societal organizations. She has extensive lecturing experience in both the Netherlands and abroad, and is honorary judge at the High Court of Tariffs and Trade for appellate competition law cases and Academic Partner to the Central Planning Bureau.

Career

After graduating with honours from Utrecht law school in 1996, Anna Gerbrandy worked as a lawyer in the European law practice of an internationally-oriented law firm, and later at the competition law chamber of the District Court of Rotterdam. Returning to her roots at the Europa Insituut of Utrecht University in 2002, In 2007 Anna defended her PhD thesis on the convergence between European and Dutch competition law in administrative review proceedings, receiving the honour cum laude. Since 2014 she is professor of Competition Law. Anna is chair of the Public Economic Law section, and responsible for the Law & Economics masterprogramme. She also holds a position as Honorary Judge at the Administrative High Court for Trade and Industry and is appointed Academic Partner to the Central Planning Bureau. 

As of January 2017 Anna is Journal Editor of Markt en Mededinging (Market & Competition), after being on the Editorial Board of the Netherlands Journal on European Law since 2004. She is also Journal Editor for Mediaforum and has been board member of other law societies in the past.

Anna Gerbrandy's research focuses on two main strands.

One strand is related to the interplay and tension between (European) competition law and public interest-aimed agreements between firms. She has written on this topic from various angles, both in Dutch and in English. She is frequently asked to become involved in national and international discussion groups relating to sustainability and competition law, is a member of the Social and Economic Council Working group on this topic and has held presentations for a.o. the OECD and Dutch Parliament. This research has become increasingly more interdisciplinary, especially when relating to fundamental issues as fairness, equity, and the role and position of competition law in a society beset with global challenges.

A second strand relates to the position of the judge in economics-based cases. Questions of deference on complex economic assessments, on the (im)possibility of establishing truth when dealing with uncertainties and on economic proof are issues that have been the subject of publications and conference speeches. 

In both strand the interplay between the European and national levels of regulation, private and self regulation and supervision, including questions of autonomy, divergence and legitimacy play a role.

Teaching activities (after completion of Doctorate)

Since completing my Doctorate in September 2009 I have been involved in teaching at Bachelor’s, Master’s and post-graduate levels; lecturing for large groups (of over 500 students at Bachelor’s level) and in smaller settings (5-100 students), teaching seminars, participating in expert meetings and supervising Bachelor’s and Master’s theses (in Dutch and English) and giving many tailored courses to professionals. In addition to coordinating several individual courses, including a course in the new multidisciplinary master European Governance, I am the programme coordinator of the law-department of the one-year Master’s in Law and Economics – an interdisciplinary international Master’s in English. Since 2015 I am also the Dean of the Legal Research master, a prestigious two-year masterprogramme.
In 2011 I was selected to partake in the prestigious one-year CEUT (Centre for Excellence in University Teaching) course on Academic Leadership. Since September 2013 I have been appointed as Teaching Fellow of Utrecht University, a two-year position for lecturers involved in innovation of University-teaching. Since 2015 I am member of the board of the CEUT. I was also Onderwijscoordinator IER (Teaching Coordinator of the International and European Law Division) until January 2014, am a member of the Opleidingscommissie masters (Master’s Programme’s Committee), co-founder of the Teaching Academy Utrecht University (Tauu.uu.nl), and member of temporary commissions relating to the curriculum and/or teaching activities.

I hold both the BKO (Basic Qualification of Education) and the SKO (Senior Qualification of Education) certificates.
Outside Utrecht University I am often involved in national and international professional training projects, for example training programmes for the judiciary, and have advised on the Nieuwe Stagiaire Opleiding, the new training programme for members of the Dutch bar. I am now a member of the Board of Supervision for the bar education programme.
In lecturing at Utrecht University my research is integrated in teaching, more so at the master's level than at bachelor's level, but even in the bachelor phase ongoing research is used, discussed and elaborated upon.
