Call for Papers: Can Public Procrement Law Do It All?
Utrecht University is organising the conference Can Public Procurement Law Do it All? Coherence and Trade-offs in a Fragmented Landscape of EU Law, on 17 June 2027, in Utrecht. We invite researchers, academics and practitioners to submit abstracts for this conference, the deadline is 15 January 2027.
Public procurement needs to achieve it all. A single tender today may be expected to deliver value for money, open the market to SMEs, cut lifecycle emissions, keep the value of products and materials in circulation, secure supply chains against geopolitical risk, drive innovation, and do all of this while respecting equal treatment, transparency and proportionality. Each of these expectations is legitimate. Each is, increasingly, a matter of EU law as well. But they were not designed together, and they do not always point the same way.
Whereas the objective of the Public Procurement Directives has been to create an internal market for a long time, many other Directives and Regulations are now part of EU public procurement law, aiming to achieve objectives noted above and more. The total number has far exceeded 60 by now, resulting in a fragmented landscape. The recent European Commission’s proposal for a Public Procurement Act reinforces this development by putting more principles and more objectives on the table for public procurement. These tensions take a different form when procurement is used to create markets or insure against disruption.
This raises fundamental questions: can EU public procurement law do it all? What conflicts and synergies exist? And: what does coherent and effective public procurement law look like in the European Union?
