Online lecture by Sir Robin Jacob on Brexit and Intellectual Property Law


On Wednesday 23 June 2021 between 15:00 and 17:00 CET, Sir Robin Jacob will speak about the consequences of the Brexit for intellectual property law in the United Kingdom and the European Union.

The UK's decision to leave the EU has unprecedented and partly unforeseeable consequences for IP law. A Trade and Co-operation Agreement has been reached, but how does it turn out in practice? Will a EU trademark be liable to revocation if it is put to genuine use in the UK only? Will an EU license or a pan-European prohibitory injunction ordered by a Court last year, still apply in the UK this year? In his lecture, Sir Robin Jacob will give an overview of these legal issues and other consequences of the Brexit. He will also indicate on which points British IP law is expected to depart from the EU acquis. For example, will British case law return to the old British interpretation of the copyright work concept or will it continue to follow the case law of the Luxembourg Court? Will British IP rights remain exhausted when goods are marketed in the EU?

Sir Robin Jacob has been one of the world's leading IP experts for decades. After a life as a British barrister and judge, he is currently Professor of IP Law at University College London. Given his vast knowledge and experience, he is uniquely qualified to provide insight into current and upcoming developments in a complex IP area such as the Brexit. We are therefore proud and honoured that he will give the CIER lecture on this subject.

To stimulate the debate, we have asked two panellists to join Sir Robin Jacob in the discussion. Dr Luke McDonagh will focus on the consequences of the Brexit for the UK. Dr Alexander Tsoutsanis will discuss the consequences for IP practice in the EU. Luke McDonagh is an Assistant Professor at the London School of Economics and has published widely on the Brexit and IP. Alexander Tsoutsanis is Legal Director at DLA Piper and active in both the legal practice and academic research in the IP field.
